Terms and Conditions
Any order submitted on the website are subject to the terms and conditions ("the Conditions") set out below. Any reference in the Conditions to writing includes facsimile and e-mail; reference to the Parties means You and Pike And Shot Events Ltd ("PASTE"); and any reference to Working Days means between 09:00hrs and 17:00hrs on any day excluding Saturdays, Sundays, and UK Public Holidays.
1. Retail Sales
1.1 You may place an order for goods ("the Goods") by submitting a completed order form on the Website. If PASTE accepts your order, it will confirm acceptance in writing and will supply the Goods to you in accordance with Your order and these conditions ("the Contract")
1.2 PASTE intends the terms set out in these Conditions to be included in the Contract. Please read the Conditions carefully and inform PASTE if you do not understand or agree with anything in these Conditions. If you require any changes, please make sure you ask for these to be put in writing, to avoid problems in understanding what each party is expected to do. Any changes to these Conditions must be agreed by both parties.
2. Orders and prices
2.1 Prices on the Website are valid for the time indicated on the Website [and are subject to availability while stocks last].
2.2 In addition to the price shown for the goods, You will pay Value Added Tax where appropriate, plus the delivery charges shown on the Website order form ("the Delivery Charges")
2.3 In the event of an error in any price, sales literature or other document or information issued by PASTE or placed upon the Website, PASTE will correct the information and will notify You as soon as possible of any such error in Your Contract. If you do not wish to proceed on the basis of the correct information, You will be entitled to cancel the relevant part of the Contract and to receive a refund for the part You have cancelled.
3. Right to cancel
3.1 This clause does not apply to event or tour tickets
3.2 You have the right to cancel the Contract and return the Goods (other than Tickets) in their original condition within 7 Working Days of receiving the Goods by giving written notice of cancellation, and PASTE shall refund to You the price of the Goods less the Delivery Charges (except as stated in clause 4.2).
3.3 Contrary to clause 9.1.1, if You post Your notice of cancellation under clause 3.2 it will be deemed to be given to PASTE on the day You post it.
3.4 Where You are returning the Goods (excluding Tickets) because of an error on PASTE's part, or because of a defect in the Goods, PASTE shall refund to You the price, the Delivery Charges in sending the Goods to You, and the cost You incur in returning the Goods to PASTE by the same method as they were delivered to You.
4. Payment Terms
4.1 You may order via the Website, over the telephone, or by Email. You will be required to give credit card details at the time of submitting your order and payment will be made at the time Your order is accepted by PASTE. 4.2 If you wish to pay by cheque, You must print off a copy of the order form and send it to PASTE by post with Your cheque for the price and Delivery Charges of the Goods.
5. Delivery
5.1 If no other delivery time is given on the Website, PASTE shall use reasonable efforts to deliver the Goods to You within 28 working days after receiving payment from You in cleared funds.
5.2 PASTE will deliver the Goods to the address given by You in Your order form [and if You do not take delivery or have given inadequate delivery instructions PASTE may store the Goods until actual delivery and charge You for the reasonable costs (including insurance) of storage and redelivery].
6. Ownership
The Goods do not belong to You, even though they may have been delivered to You, until PASTE has received the total price (including Delivery Charges) in cleared funds from You. Until that time, You will be responsible for any loss or damage to the Goods (unless caused by PASTE) and PASTE may require You, upon reasonable notice, to return and deliver up the Goods to PASTE, failing which PASTE will take legal proceedings to recover the Goods or their value.
7. Warranty and Liability
7.1 Nothing in this clause 7 shall exclude PASTE's liability for fraudulent misrepresentation or for death or personal injury caused by it's negligence.
7.2 PASTE will not be liable for any losses related to any business You might have and where either Party breaches this Contract that Party shall not be liable for any costs or losses suffered by the other Party (or any third party) except where those losses are a reasonably foreseeable consequence of the breach.
7.3 If, notwithstanding the rest of this clause 7, liability attaches to PASTE in no circumstances shall PASTE's liability to You for a breach of any express or implied terms of the Contract or any other duty of any kind imposed on PASTE by law arising out of or in relation to the Contract exceed the total amount paid for the Goods.
7.4 In no event shall either party be responsible for delays over which it has no reasonable control.
8. Termination
8.1 PASTE may terminate this Contract or any other contract between the parties and may cancel or suspend future deliveries (under this Contract or any other contract) if Your belongings have been taken away from You to pay off Your debts, or a receiving order has been made against You.
8.2 Either Party may terminate this Contract or any other contract between the parties and may cancel or suspend future deliveries (under this Contract or any other contract) if the other Party is in breach of these conditions or any other contract between the parties, and that breach, if capable of remedy, has not been remedied within [14] days of the innocent Party giving notice of the breach.
8.3 On termination, all outstanding payments under the Contract shall be payable immediately.
8.4 Termination shall not affect the rights that You or PASTE have under the Contract.
9. General
9.1 Any notice required under these Conditions shall be in writing addressed to the other Party at its registered office or any other address notified by the receiving Party to the Party giving the notice. Any notice shall be deemed to be served:
9.1.1 If sent by pre-paid first class post to the Party to whom it was given, on the third working day after posting; or
9.1.2 If sent by pre-paid air-mail post to the party to whom it was given, on the eighth Working day after posting; or
9.1.3 if sent by email to the Party's email address at the date and time given on the sender's transmission acknowledgement slip (or in the case of manifest error or loss of the slip) on receipt.
9.2 No third parties shall have any rights under this Contract as a result of the Contracts (Rights of Third Parties) Act 1999. No variation to this Contract and no subsequent agreement to this Contract created any such rights unless it expressly states so.
9.3 If any of these Conditions is held by any competent authority to be unlawful, or unenforceable in whole or in part the validity of the other provisions of these Conditions and the remainder of the provision in question shall not be affected and shall continue to be valid and enforceable to the fullest extent permitted by law.
9.4 The Contract and these conditions shall be under English Law and are subject to the jurisdiction of the English Courts or, where you are a resident in the European Union, the courts of Your Country of residence.
9.5 You shall not transfer, assign or sub-contract Your obligations under the Contract without PASTE's prior written consent. PASTE may sub-contract any of its obligations under this contract provided that Your rights are not adversely affected as a result.
9.6 Failure or neglect by PASTE to enforce at any time any of these Conditions shall not be a waiver of Our rights and it shall not affect the validity of the whole or any part of these Conditions or prejudice Our right to take subsequent action.
10. Event and Tour Tickets
10.1 Once purchased, tickets cannot be transferred, exchanged, refunded, or returned unless the Event is cancelled, moved to another date, or if the details of the event are significantly changed after an order is placed (significantly changes being a change of headline act (Concerts Only) venue or show time)
10.2 In the unlikely event of a cancellation of an Event by the venue (i.e. a cancellation due to circumstances beyond PASTE's control), PASTE will only refund the face value of the ticket. PASTE will use best endeavours to contact purchasers either by phone, email, or writing (using the details provided at the time of ordering) and advise them to return the tickets. Please note, however, it is the customer's responsibility to check whether the event is going ahead at the scheduled date, time, and venue, and PASTE cannot guarantee that they will inform the customer of any changes to the event date, time, or venue.
10.3 We advise the use of secure mail when returning tickets. On receipt, PASTE will refund the customer the face value of the ticket using the same method as used to purchase them.
10.4 If an event is moved from it's advertised venue and/or the date is changed, tickets already purchased may remain valid should the customer wish to attend the revised event. If not, PASTE will refund the face value of the tickets. PASTE will notify all purchasers by phone, email, or in writing (using the details provided at the time of ordering) to advise on the validity of the tickets and the procedure for obtaining a refund. Refund requests will normally be accepted up until 7 days prior to the revised event, or 3 days after notification of the change (whichever is the later) unless otherwise notified. In the event of a change at short notice (within 1 week of the event) PASTE will notify purchasers of the conditions that apply, and offer a refund if these are not agreeable. Please note, however, it is the customer's responsibility to check whether the event is going ahead at the scheduled date, time, and venue, and PASTE cannot guarantee that they will inform the customer of any changes to the event date, time, or venue.
10.5 Should the headline performer not appear, or if the line up or content is substantially changed from the advertised line up or content (concerts only), then PASTE will refund the face value of the tickets.
10.6 If PASTE is unable to fulfil an order for any of the reasons below the customer will be entitled to a full refund, including any booking fee charged:
PASTE do not receive the tickets for your order from the event organiser, and cannot arrange for the tickets to be collected
PASTE despatch your order to the wrong address and cannot provide replacement tickets
PASTE do not despatch your order and do not arrange for the tickets to be available for collection
PASTE despatch the wrong order, i.e. wrong event/wrong type of tickets
Any other similar circumstances where PASTE has acted with negligence or where we may have acted in breach of contract
10.7 No duplicate tickets will be issued to replace lost or stolen tickets
10.8 Customers are advised to check their purchase upon receipt
10.9 It is the responsibility of the customer to inform PASTE of any changes of address, contact phone number, or email address, both before and after receipt of goods. Please note that our preferred method of contact for customers booking online is by email, so care should be taken to provide a current and valid email address.
10.10 The right to admission to an event is reserved by the promoter and event venue, who may take health and safety, environmental and security concerns into account at their reasonable discretion, and may from time to time carry out security searches. PASTE would advise customers that no refunds will be offered to customers who are refused entry or ejected from a venue on account of late arrival, being (or appearing to be) under age*, declining to be searched, abusive, threatening, drunken, or other anti-social behaviour (including smoking in no smoking areas), carrying offensive weapons, or illegal substances, or making unauthorised audio, video, or photographic recordings.
{18}*Events and ticket types where an age restriction applies are clearly indicated during the booking process. Please ensure that you read all the information that applies to the event/ticket you are booking, and carry proof of age if appropriate.
10.11 If it becomes impractical to post tickets out, due to the proximity of an event or circumstances beyond our control, we reserve the right to make tickets available for collection at the venue immediately prior to the event. Customers will be notified by phone, email, or in writing (using the details provided at the time of ordering) if this becomes necessary.
10.12 By ordering you agree that the tickets are for the personal use of you and your party only, and will not be resold or transferred. Any resale, or attempt to resell the tickets at a price higher than purchased will result in your orders being cancelled without prior notification.
10.13 If a customer orders more tickets than the maximum allowed, as indicated during the booking process, we reserve the right to cancel the order. The maximum applies per person/card/household
10.14 If tickets that are despatched are returned to PASTE as "addressee unknown", we reserve the right to cancel the order
10.15 In order to prevent fraud and to protect both parties, you may be asked to provide additional information after your booking so that we can verify your purchase
10.16 We will not share your personal information for marketing or any other purposes without your consent unless where required by law. If you have registered your interest with PASTE and/or any of our associated companies, and thereby given your consent, you may be contacted with relevant promotions, offers or information that you have expressed an interest in or that might be of interest to you.
